TERMS AND CONDITIONS

Welcome to Tektraco’s Online Store (“Online Store”).  Please read the following Terms and Conditions carefully before making use of our Online Store.  By using and accessing this Store you agree to be bound by and accept these terms and conditions.

Tektraco Ltd. (the “Company”) operate and control this site.  The Company reserves the right, at its sole discretion, to modify, alter or otherwise update these Terms and Conditions at any time, and by your continued use of the Store you agree to be bound by such modifications, alterations or updates.

Tektraco’s authorized agent in Libya, Delta Labtech (“Delta”) is being authorized by the Company to issue quotations, invoices and delivery notes on its behalf.

This Online Store is accessible only to customers residing in Libya (Great Socialist People's Libyan Arab Jamahiriya). 

 

1. Privacy & Security:
1.1 Tektraco Ltd. is committed to protecting your privacy and maintaining the security of any personal information received from you.  We strictly adhere to the requirements of the data protection legislation in the Maltese Islands.

1.2 When you want to make an online order, we need to know your name, address, email address and telephone number.  This allows us to process your order and get in contact with you on its status.  You have the option to withhold personal information that is not required for the order process.

1.3 We use your personal information to get in contact with you, and if needed to give you information relating to your orders with us.

1.4 We do not sell, rent or exchange your personal information with any third party for commercial reasons.

1.5 We follow strict security procedures in the storage and disclosure of information which you have given us, to prevent unauthorised access in accordance with the data protection legislation.

1.6 We do not collect sensitive information about you except when you specifically knowingly provide it.  In order to maintain the accuracy of our database, you can check, update or remove your personal details by logging into your account online.

3. Availability and Pricing:
3.1 Listed prices are in Libyan Dinars (LYD).

3.2 Product listings, specifications, availability, and pricing are subject to change without notice.  Orders are not binding upon the Company until accepted by an authorized representative of the Company.

3.3 The Company reserves the right to refuse service, terminate accounts or cancel orders in its sole discretion. 

3.4 When ordering from our supplier’s online catalog, the prices shown therein reflect the latest information available at the time of uploading of their electronic catalog.  These prices are subject to confirmation from the Company.  Prices charged will be those prevailing when an order is placed.
3.5 The Company reserves the right to designate a minimum order value for online orders that include products that are not available from stock.  Such orders having a total invoiced value (excluding any additional transport, insurance, packaging and/or additional costs) of less than 900 Libyan Dinars (LYD) will not be accepted.
3.6 For any items which are not in stock in its online store, the Company is giving you the option to order these products.  On receipt of your order, Tektraco’s authorized agent in Libya, Delta Labtech, will send you a quotation for the required items, including any applicable additional charges.  This quotation remains open for acceptance by you within the period stated in the quotation or if no period is stated, within 30 days of the date of the quotation, irrespective of when you receive the quotation.  The prices quoted will be those prevailing when the quotation is issued and may be different from those quoted on the online store.

 

4. Payment:
4.1 For all orders received through our Online Store, Delta Labtech reserves the right to request a down payment, amounting to 20% of the order value.  On receipt of this payment, your order will start to be processed and you will subsequently receive an order confirmation by email.  No orders will be processed until the respective 20% down payment mentioned above is received.

4.2 For all orders received through our Online Store, our standard terms are payment of full invoice value (less down payment already paid) on delivery of goods.  If customer fails to effect payment, goods will not be delivered.

 

5. Delivery:
5.1 Delivery of goods ordered online can be effected by the Company directly to client’s address in Tripoli (Libya) only, depending on the order value.  In the case of low value orders, additional delivery charges may be applicable.  For deliveries outside Tripoli, an additional delivery charge will be charged, depending on the delivery address.  Other charges may also apply if goods ordered are required to be delivered urgently.  Any applicable additional charges, as mentioned above, will be clearly indicated on the order acknowledgement you will receive following your order.
5.2 For all online orders received, in particular those with non stock items, the Company will quote delivery dates when these become available and will undertake to adhere to these specified delivery dates.  However, in all cases, delivery dates are estimated only and without commitment by or obligation on the part of the Company. The client shall not be entitled to cancel any order or to delay or refuse payment should delivery be made after the specified delivery date.
5.3 The Company reserves the right to include an additional charge to cover additional shipping costs including, without limitation, direct shipments from the manufacturer or any specialised packaging. This can include the packaging of hazardous materials and dry ice charges.
5.4 If the client fails to accept delivery within 15 days of notice that the goods are ready for delivery, he shall be liable for all the Company’s storage and other charges and the Company shall be entitled, without prejudice to its other rights, to resell or otherwise dispose of the goods.
5.5 Claims for shortages or damage to goods before risk passes, must be made in writing within 15 days of receipt failing which proper delivery shall be conclusively presumed to have been made.
5.6 Goods should not be returned for any reason other than that set out in Clause 6 below.  For those clients who still wish to return any goods ordered online, please refer to the Company’s Returns Policy.

 

6. Warranties:
6.1. Subject to fair wear and tear, and the due observance of any installation, user, storage, operating or maintenance instructions the Company undertakes to replace or at its option repair free of charge to the Purchaser any goods which the Purchaser can establish are defective by reason of defective workmanship or materials and which are returned to the Company carriage paid within 12 months of the date of receipt by the Purchaser.

 

7. Registration
7.1 You may be required to register your details to use certain services provided on our Website.  You may register with us by providing your name, address, phone number, and email address.  Please refer to our Privacy Policy above for more details on how we protect your information.

7.2 You may need a username and password to access certain areas of the Website.  You are responsible for maintaining the security of your username and password and you are responsible for any action taken under your username or password.  We take reasonable steps to ensure the security of your information on our systems.  Please refer to our Privacy Policy above for more details on how we protect your information.
